We do not rent Vespas, but we do rent the latest generation of EMCO Electric Scooters

Rent & Payment
The scooters can only be rented via our online platform www.scootandfood. be The Hirer confirms that he/she has been given adequate time and opportunity to carefully read the terms and conditions and agrees to be bound by them in their entirety. The hirer is asked to inform all co-drivers and/or passengers to read, understand and accept these general conditions (the rental conditions can be viewed at all times via our website at the bottom of each page). Before departure all hirers can have acces to these general terms and conditions on site as well.
All rental payments and booked extra’s must be paid in full upon booking. 

Return of the rented scooter and all supplied equipment

The hirer agrees to return the vehicle together with all tyre’s, tools, accessories and other equipment in the same condition as received at commencement of this Rental Agreement to the place and on the date and time specified by the lessor: Oude Nieuwpoortstraat 1 Pervijze-Diksmuide. The vehicle documents, including a road map, are given in advance by the lessor and must be kept in the luggage compartment of the vehicle. Before handing over the vehicle, the user- and safetyaspects and the operation of the vehicle will be given and demonstrated. A test drive is possible if requested. The user conditions and agreements as well as all instructions given by the lessor must be followed strictly and implemented immediately by the hirer.
When returning the vehicle, any damage caused will be listed and recorded (photograph, drawing or by any other means) in the presence of the hirer. This listing will be signed, or certified in any other way, by both parties. 

There are no specific clothing requirements (with the exception of a mandatory helmet), though adequate clothing is recommended. Bare arms and legs are more susceptible to injuries or sunburn (sunscreen is always a good idea). Flip flops and high heels are prohibited! We advise you to wear sunglasses when it’s sunny and to always be prepared for bad or cold weather (scarf, gloves, waterproof clothing,…).

Legitimation and age
The hirer will be asked to identify himself with a valid and recognizable identity card (this will be photographed via mobile phone before departure). The driver of the scooter must be at least 23 years old. Any passenger must at least be 8 years old and be tall enough to rest the feet on the footrest (except for children between 3 & 8 years when a child seat is used). However, if a valid driver can personally guarantee for someone the age of 18 till 23, the last named is allowed to drive the vehicle provided there is an exemption in the civil liability insurance of 300 euros for the person under 23. It is strictly prohibited and against Belgian Traffic Law to let children stand on the footplate between the driver and the steering wheel while driving! In the event of a possible accident or injury, the costs will not be recoverable from our liability insurance and the driver will be liable for any resulting costs that may arise from this or other irresponsible driving behavior.

Electric and GREEN technology  
At the start, the scooter is equipped with 2 fully charged 37 ah batteries with a range of at least 100 km (depending on weight, driving style, terrain and temperature). A travel distance of 100 km is guaranteed at all times. Should a flat battery nevertheless occur, a new fully charged battery will be brought to the place where the tenant is at that moment. However, a cost of 25 euros is charged if it is outside the predetermined distance.

In case of damage at the time of rental and regardless of the cause, the lessor has the right to immediately charge the hirer a fee which should be commensurate with the costs for repair and other damage (read below under the heading ‘damage’).  These costs will immediately be calculated and documented in a provisional file by Electric Scooters & Bikes, Bruggesteenweg 261 8830 Hooglede-Gits or in their absence by Scoot & Food. When it appears after repair and on presentation of the invoice that the calculated costs were higher than the actual damage, the remaining amount will be refunded. If the loss is greater than the balance of the deposit, an invoice will be raised and the additional amount must be paid by the hirer within 8 days following the payment.

Traffic regulations – GPS
The tenant must at all times comply with Belgian traffic legislation. In addition one is ought to responsibly approach and handle the vehicle. It is forbidden to use alcohol, drugs and/or medicines that affect the driving skills both before and during the use of the vehicle. The driver is obliged to wear the helmet while driving the scooter. Use of a mobile phone is absolutely prohibited while driving. The Hirer agrees that any fixed penalty fine or associated charge incurred by the Hirer whilst the vehicle was in his/her custody will be charged to the Hirer at a time during or subsequent to the hire or when such fines are received by the Lessor. The Hirer also agrees to pay an administration fee of €25 for each fine received payable to the Lessor for dealing with these matters.

The GPS that is offered should be seen as an expedient and does not replace the traffic regulations. The directions on the GPS should not be followed blindly. The applicable traffic regulations take precedence over the navigation tool. 

Breakdown, accident and insurance   
In the event of a breakdown (eg flat tire), the tenant has to contact us. When repair is not possible on site, the vehicle will be towed to either the repair service (Electric Scooters &  Bikes  Bruggesteenweg 261  8830 Hooglede-Gits) or to Oude Nieuwpoortstraat 1 in Diksmuide. The driver of the scooter will be returned to the address of the lessor. For accompanied drivers between 18 and 23 years old, the vehicle insurance includes cover for Third Party with a franchise of 300 euros. There is no comprehensive insurance.        

A rental fee will be charged upon late return (after 1.30 pm for morning rentals and after 6.30 pm for afternoon or full day rentals) of the vehicle (€10 for each half hour started).

The tenant is not allowed to lend, sublet or hand over the vehicle to any person other than the hirer who has signed the Rental Agreement or who has been nominated as the rider by the hirer and approved by the lessor.

As permitted by traffic legislations a maximum of one passenger may be transported with the rented scooter. The passenger is also obliged to wear a helmet. Pets are not allowed to be transported.  Children between 3 and 7 years old can only be transported in a child seat wearing an adapted helmet. 

Weather conditions       
Based on bad weather predictions and only in consultation with the lessor, the hirer has the right to cancel (3 working days in advance minimum) and rebook the reservation. Only in this case, the reservation can be moved to another date, within a maximum period of 6 months.

Cancellation for personal reasons must be done at least 3 working days in advance. In that case, the reservation can be moved to another date, within a maximum period of 6 months, or we can provide a voucher for the same amount.
If canceled without serious reason or if the reservation is not moved within the specified time frame, 50% of the total rent and all extras booked (meals, team building…) will be charged as compensation for damages. If the tenant does not show up, the full amount of the reservation will be charged.  

When parking the vehicles, the tenant must take the necessary precautions against theft, the use of the steering wheel lock is mandatory. The luggage compartment must also be locked so that the vehicle documents cannot be stolen. The vehicle must never be left out of sight of the hirer.

In the event of theft, loss or complete destruction, the renter is liable for the total and actual damage to the vehicle, however caused, regardless of whether this is a result of the fault of the renter or third parties on the public road or private domain. Also in the event of loss of the vehicle documents by the tenant, the latter will be responsible for the resulting costs. The damage due to loss of rent is not included in this and can therefore be additionally claimed. The tenant will immediately notify the lessor of any accident, damage, destruction or disappearance in which the rented property is involved (notification obligation). In the event of a collision, the tenant undertakes to submit a written, fully completed collision form and/or any official report to the lessor. The tenant will refrain from making any adverse (liability) acknowledgment. If any claim or charge is made for death, personal injury or damage to property, condition, use or utilization of the rented property, the hirer must promptly notify the lessor and provide the lessor with a copy of each claim, notice, subpoena, proceeding and plea received in connection with this while co-operating with the landlord in defending them.
The lessor is not responsible for damage or breakdown as a result of weather conditions.
If the tenant does not comply (in time) with the above notification obligation and this would lead to loss of claims to an insurance payment or the possibility of holding a third party liable for the damage / loss incurred or would otherwise damage the landlord the tenant is liable for this damage and will indemnify the landlord for this.

Act with due and proper care     
The tenant undertakes to use only paved roads and asphalted cycle paths. The tenant is not allowed to cross national borders. All repair and / or cleaning costs as a result of driving on curbs, forest paths, cobblestone roads, unpaved roads or field roads  (unless one follows the routes set out by the lessor on GPS) are at the expense of the tenant.  The lessor is entitled to immediately recall the vehicle after alleged misuse or after established violations of the general rental conditions and to have it returned, without any compensation of the rent.

Personal data protection
The protection of customer data is extremely important to Scoot & Food. We undertake not to use this data to identify you for commercial purposes or to pass it on to subcontractors for such purposes. The customer data can only be used in the context of the implementation of this agreement.  This information can only be used for sending promotions or newsletters, with the explicit consent of the customer-tenant. 

Force majeure
If the lessor, due to force majeure, cannot make the rented property available to the tenant, the lessor cannot be held responsible for this. However, the lessor will do whatever it takes to remedy the situation as correctly as possible or will propose an appropriate alternative. The lessor can never be imposed a financial compensation (eg in case of damage or late arrival by the previous tenant, weather conditions, safety reasons, road works, etc…).    

Gift card
The “gift voucher” can only be ordered and paid via our website. It is valid for up to one year from the date of deregistration and can be transferred to a third party. After the end date, the voucher expires definitively and no rights can be derived from it.                                                                                                   

Food                                                                                                                                                                                                                                                                                If you wish, you can additionally and only by reservation in advance, enjoy a breakfast, BBQ or braai at our farm (address Scoot & Food, payment on site). Children are allowed, but only under strict supervision and responsibility of their parents. We do not provide child care facilities. It is forbidden to enter the meadow and the private part of the residence. The farm is partially enclosed with a deep well behind the private residence (danger of drowning). The company Scoot & Food, and its managers can not be held responsible for accidents within the grounds of the farm.

Competent court         
In the event of a dispute, only the courts in Veurne have sole competence.
